Certificate for Public Use

This page explains how to apply to Tasman District Council for a Certificate for Public Use. 

 This Certificate is required to verify that it is safe for members of the public to enter all or part of a public building that is being affected by building work. 

It is an offence to permit people to use parts of premises intended for public use that are affected by building work, unless the Council confirms it is safe to do so.  The requirement is a tool of the Building Act 2004, Section 363, relating to owner, occupiers and people who control premises intended for public use.  Section 363 applies in the following situation:

  • A building consent has been issued to undertake the building work, but a Code Compliance Certificate has not yet been issued.

The Council can take into account any safety precautions that have been put in place and will issue a Certificate for Public Use where it is satisfied it is safe for members of the public to use the premises.

Once all the building work is complete a Code of Compliance Certificate must be obtained. 

The Certificate for Public Use is processed upon receipt of the Application Form with the fee.

Once complete, an inspection needs to be arranged between the applicant and a Council Building Inspector.

Your application will need to be accompanied by the correct form and fee. Please also include plans showing hoardings etc, as this will help the building inspectors ascertain if public safety can be preserved.
