Do I Need a Building Consent for My Swimming Pool?

Can a Building Consent Be Issued Prior to a Resource Consent?

A building consent may be issued prior to the approval of a resource consent, however this will usually be subject to a certificate attached, restricting the commencement of the work until the resource consent has been granted.

At What Size Does a Proposed Building Require a Building Consent?

A 'building' is defined in Section 7, 8 and 9 of the Building Act 2004 . In particular note the definition of Building and Building Work, and Schedule 1 of the Building Act (which specifies what work is exempt from a building consent).

Building Act 2004

It is not just the size of the building that determines the requirement for building consent. A Building Consent Officer can help explain this to you.

You can build a small accessory building (shed, pergola, gazebo, glasshouse, sleepout) without a building consent if the building:

is under 10m2 in area; and

contains no sanitary facilities; and

is single storied; and

is at least its own height away from the property boundary and from any residential building on the property or any neighbouring property; and

is not a spa or swimming pool enclosure or fence.

Even if a building consent is not required, the construction still needs to comply with the NZ Building Code. This includes spouting and storm water control.

You will need a building consent if it does not meet the above requirements.

Do I Need a Building Consent to Do Electrical Work in My House?

No you do not require a building consent. Council has no jurisdiction over electrical work.

Do I Need a Building Consent to Re-pile My House?

In accordance with the Building Act 2004, a building consent is not required for part re-piling unless there are changes to the structure or structural integrity, Full re-piling does require building consent as structural integrity will be affected,i.e. under pinning, foundation design change, or change of pile layout. In such circumstances a building consent is required.

Owners are recommended to obtain a building consent in all cases for the purpose of recording the work.

Do I Need a Building Consent if I Want to Plaster Over the Brick Veneer of My House?

Plaster rendering over brick veneer work does not require a building consent. The plaster must not cover the weep holes inset in the bottom brick row.

Do I Need a Building Consent if I'm Carrying Out Re-cladding on My House or Building?

If you are repairing the cladding and replacing with the same materials then no building consent is required, unless the existing cladding has not met the durability requirements of the Building Code which is 15 years.

If you are changing the cladding material e.g. from weatherboards to stucco or some other material, then you will require a building consent.

Do I Need a Building Consent to Build a Deck on My Property?

A building consent is required for a deck where it is more than 1m above the ground. The deck must be constructed in accordance with the Building Code and details such as the structure, balustrade and planning requirements will be checked.

If you are planning the use of shade cloth as a balustrade, you will need to talk to a Building Consent Officer as this is an alternative solution to the Building Code and there are various requirements which must be checked.

What Are the Building Requirements for Double Glazing?

The energy efficiency building requirements of the 3rd Edition of Clause H1 of the New Zealand Building Code were introduced on 31 October 2007, making double glazing necessary in most new houses to meet the new glazing R-valve of 0.26.

It still may be possible to use single glazing by using a heat loss calculation (Calculation Method - NZS4218:2004) that allows the insulation in one part of a house to be traded against the insulation in another part of the house. You should discuss this with your designer as they will be required to provide calculations demonstrating compliance with NZS4218:2004 with any building consent application.

Note, the new requirements of the 3rd Edition of Clause H1 only apply to building consent applications, applied for on or after 31 October 2007.

My Building Consent Says I Have to Install Smoke Detectors. What Specifically Do I Need and Where Can I Get Them?

Under Sections 112 and 115 of the Building Act 2004, smoke detectors with a 'Hush' facility are required in all dwellings or residential units that require a building consent to be issued. This includes new buildings, altered buildings, or buildings changed to a residential use. Free standing non habitable buildings (i.e. garages or sheds) and site drainage do not invoke the requirement.

Most single level houses will require a minimum of one smoke detector, however it is important to think of the whole escape route. If the hallway adjoining the bedrooms lead (via a door) through another space to the exit door, that space will require a detector as well. Two storey houses will require detectors at both levels, regardless of which level the sleeping activity is on.

All applications for consents will require complete floor layouts with room names, doorways and the smoke detectors clearly marked.

Standard smoke detectors which are already installed can remain but 'Hush' models must also be installed. A ‘Hush’ or ‘double button’ smoke alarm differs from older models in that they have an additional button which allows the alarm to be quietened for a period of time while the cause of an accidental triggering of the alarm is fixed (e.g. burnt toast). These detectors are available at most hardware stores.

Do I Need a Building Consent for My Swimming Pool?

The Building Act requires that all pools intended to hold more than 400mm of water are to be installed under a building Consent.

This applies not only to the installation of the pool, but also to the construction of any pool fence.

Building Warrant of Fitness and Compliance Schedule

This page outlines when a Building Warrant of Fitness and the supporting Compliance Schedule are required and how to apply. There are also some Council answers to frequently asked questions about the Building Warrant of Fitness.

A Building Warrant of Fitness (BWOF) is a building owner's declaration that the specified systems have been maintained in accordance with a Compliance Schedule. A copy of the Building Warrant of Fitness must be provided annually to the Council and publicly displayed at the building it pertains to.

A Compliance Schedule is a document that is required by the Building Act 2004 and prepared by the Council. It details the inspection, maintenance and reporting of a specified system such as sprinkler systems, emergency lighting and fire alarms (view the full list below) to ensure that the building owners take responsibility to guarantee the safety of building occupants and buildings.

Forms

Application for Compliance Schedule

When you Need a Building Warrant of Fitness

You are required to have a Building Warrant of Fitenss (BWOF) if your building contains any of the following specified systems:

automatic systems for fire suppression (for example sprinkler system)

automatic or manual emergency warning systems for fire or other dangers (other than a warning system for fire that is entirely within a household unit and serves only that unit)

electromagnetic or automatic doors or windows (for example ones that close on fire alarm activation)

emergency lighting systems

Certificate of Acceptance

Certificate of Acceptance

This page outlines how to apply for a Certificate of Acceptance. This is a new tool in the Building Act 2004. It can be used in situations where work has been done without a building consent, or where a building consent authority cannot issue a Code Compliance Certificate.

A Certificate of Acceptance has some similarities to a Code Compliance Certificate in that it will provide some verification for a building owner / future building owner that part or all of certain work carried out complies with the Building Code.

A Certificate of Acceptance is based on the Building Code at the time application is made, rather than what was in place at the time a consent was granted, should have been applied for, or when the work was actually carried out.

Applying for a Certificate of Acceptance

A Certificate of Acceptance application form will be required to be filled out, this will require two copies of plans and specifications for this building project to be included.  You will need to provide plans and the following information that show;

site location

layout

elevations

pile/foundation details

all drainage details

cross-section details

flashing details for windows, doors, wall

roof junction details

specifications for materials used

insulation types

cladding details

Copy of Certificate of title as evidence of ownership, no more than 3 months old.

A report from a suitably qualified, registered and experienced building surveyor will be required to accompany the application. This report will need to verify standard of construction for building, plumbing and drainage work.

Please phone the Tasman District Council on 03 543 8400 to make an appointment to discuss your application with a Duty Building Consent Officer.

Certificate of Public Use

Certificate for Public Use

This page explains how to apply to Tasman District Council for a Certificate for Public Use.

This Certificate is required to verify that it is safe for members of the public to enter all or part of a public building that is being affected by building work.

It is an offence to permit people to use parts of premises intended for public use that are affected by building work, unless the Council confirms it is safe to do so. The requirement is a tool of the Building Act 2004, Section 363, relating to owner, occupiers and people who control premises intended for public use. Section 363 applies in the following situation:

A building consent has been issued to undertake the building work, but a Code Compliance Certificate has not yet been issued.

The Council can take into account any safety precautions that have been put in place and will issue a Certificate for Public Use where it is satisfied it is safe for members of the public to use the premises.

Once all the building work is complete a Code of Compliance Certificate must be obtained.

The Certificate for Public Use is processed upon receipt of the Application Form with the fee.

Once complete, an inspection needs to be arranged between the applicant and a Council Building Inspector.

Application for Certificate for Public Use

Your application will need to be accompanied by the correct form and fee. Please also include plans showing hoardings etc, as this will help the building inspectors ascertain if public safety can be preserved.

Earthquake Prone, Dangerous and Insanitary Buildings Policy

This page links you to Council's Earthquake Prone, Dangerous and Insanitary Buildings Policy - adopted by Tasman District Council in accordance with the requirements of the Building Act 2004.

Earthquake Prone, Dangerous and Insanitary Building Policy 2006 - 2011

About the Policy

Section 131 of the Building Act 2004 requires territorial authorities to adopt a policy on earthquake-prone, dangerous and insanitary buildings by 31 May 2006. This reflects the government’s broader concern with the life safety of the public in buildings and, more particularly, the need to address life safety in the event of an earthquake.

It is a requirement that the policy be developed in consultation with Council ratepayers and stakeholders in accordance with section 83 of the Local Government Act 2002.

The policy will be reviewed every five years.

Project Information Memorandum (PIM)

Project Information Memorandum

This page explains when a Project Information Memorandum (PIM) might be required for a specific project and how to apply.

A PIM is a report relating to a specific project on a property. It discloses information that may affect approval for a proposed building project, such as:

erosion

falling debris

subsidence

slippage

flooding

presence of hazardous material

whether a Resource Consent is required

whether other laws affect the site; e.g. heritage building / sites

details of surface water and wastewater

whether a Development Contribution fee is required

whether the proposed use of the building will require an evacuation scheme approved by the New Zealand Fire Service.

The PIM provides either:

Confirmation that building work may be done, subject to the requirements of the Building Consent and provided that all other necessary authorisations have been obtained; or

Notification that building work may not be done because necessary authorisation has been refused, even though a Building Consent may have been issued.

When a Building Consent is Not Required

When a Building Consent is Not Required

Schedule 1 of the Building Act lists work that does not need a building consent.

Changes to Schedule 1 took effect on December 2010. These changes remove the requirement for building consents for low risk and minor works.

Work that is exempt under this initiative will still be required to meet Building Code requirements to ensure it is safe and fit for purpose.

Even though work may be exempt from requiring building consent approval, work must still comply with District Plan controls and resource consent approval should be obtained where necessary.

Exempt work (with examples) is listed under the Department of Building and Housing’s Publication

Restricted Building Work

This page gives brief details of what Restricted Building Work is and how it may affect you. It is sourced from the Department of Building and Housing website.

Licensed Building Practitioners

What is Restricted Building Work?

Restricted Building Work is any work critical to the structure of a building or its weathertightness.

The regulations apply to houses and small to medium apartments that are less than 10m in height (ground to highest roof excluding chimneys etc) and with no commercial parts (i.e. mixed use buildings).

Most work which needs Building Consent will be Restricted Building Work, although there are some exceptions.

More information on the Department of Building and Housing Build It Right website.

How Do I Know if My Building Work or Renovation is Restricted Building Work?

If the work to your home does not include work to the primary structure or its weathertightness, then it is likely to not be Restricted Building Work. To find out if the work you are planning is Restricted Building Work:

Use the Build It Right Homeowner’s Guide

Contact us for assistance

If you are planning restricted building work:

Use Licensed Building Practitioners to design and build your home

All Licensed Building Practitioners doing Restricted Building Work on your home must to give you a Memorandum (Record of Building Work) when their part of the work is done. It documents the work they did.

Licensed Building Practitioners

Restricted Building Work must be done by a Licensed Building Practitioner. It is important that the Restricted Building Work on your home is done by a Licensed Building Practitioner who is licensed to do that type of Restricted Building Work. For example if it is Restricted Building Work to the roof, then the tradesperson has to be licensed in roofing.

Licensed Building Practitioners

Licensed Building Practitioners

This page briefly explains what Licensed Building Practitioners are and what they do. It is sourced from the Department of Building and Housing website.

What is a Licensed Building Practitioner?

Licensed Building Practitioners (LBPs) are tradespeople and professionals who are able to design, carry out and supervise Restricted Building Work.

Licensed Building Practitioners have to show certain skills, give proof of practical experience and comply with the building code to get their licence. They also have to gain enough maintenance points every two years to keep it.

What is an LBP from the Department of Building and Housing

Check to see if your tradesperson is registered as an LBP

Other Registered Professionals

Registered Architects and Chartered Professional Engineers are automatically treated as design Licensed Building Practitioners.

Registered Plumbers and Registered Gasfitters are automatically treated as Licensed Building Practitioners in the roofing, external plastering, and bricklaying and blocklaying licensing classes. This is in recognition they carry out this type of work in the ordinary course of their business, and they must only carry out work that falls within their own competence levels.

Registered architects, chartered professional engineers and registered plumbers and registered gasfitters have their own registration systems. They won’t be listed on the LBP register.
