			<title>Land Information Memorandum</title>

			<description>&lt;h1&gt;Land Information Memorandum (LIM)&lt;/h1&gt;
&lt;p&gt;If you are considering purchasing a property in the Tasman District it is recommended that you obtain a LIM before finalising the purchase.  Any person may apply to the Council for the issue of a LIM in relation to any land in the district.  The Tasman District Council is a Unitary Authority, meaning that both Regional Council and District Council information is included in your LIM. &lt;/p&gt;
&lt;h2&gt;What Information do I Get?&lt;/h2&gt;
&lt;p&gt;Information included is covered by Local Government Official Information and Meetings Act 1987, Section 44A and will cover:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;rateable valuation data&lt;/li&gt;
&lt;li&gt;rates and water charges &lt;/li&gt;
&lt;li&gt;resource and subdivision consents&lt;/li&gt;
&lt;li&gt;building permits and consents &lt;/li&gt;
&lt;li&gt;compliance schedules, building warrant of fitness&lt;/li&gt;
&lt;li&gt;swimming pool fence compliance&lt;/li&gt;
&lt;li&gt;information notified from the Weathertight Homes Resolution Services&lt;/li&gt;
&lt;li&gt;protected buildings and trees, historic buildings &lt;/li&gt;
&lt;li&gt;drainage information relating to sewer and/or storm water&lt;/li&gt;
&lt;li&gt;domestic water supply&lt;/li&gt;
&lt;li&gt;any special features or characteristics of the land or buildings &lt;/li&gt;
&lt;li&gt;likely presence of hazardous contaminants&lt;/li&gt;
&lt;li&gt;any current requisitions issued by the Council on the property &lt;/li&gt;
&lt;li&gt;registrations and licences &lt;/li&gt;
&lt;li&gt;refuse and recycling collection information.&lt;/li&gt;
&lt;/ul&gt;&lt;p&gt;The LIM may also include any other information relevant to the land which the Council considers, at its discretion, to be relevant.&lt;/p&gt;
&lt;h2&gt;How to Apply&lt;/h2&gt;
&lt;p&gt;LIM application forms can be accessed online, are available from any Council office, or they can be posted or emailed to you.&lt;/p&gt;
&lt;p&gt;Your application needs to be in writing with sufficient information to identify the property for which you require a LIM.  A copy of the title (less than three months old) must be attached to the application. &lt;br/&gt;&lt;br/&gt;You should forward your application, with the appropriate fee, to the relevant Council office. Please be sure that all the information requested is included to enable us to return the LIM to you as quickly as possible.&lt;/p&gt;
&lt;h2&gt;When Will I Receive my LIM?&lt;/h2&gt;
&lt;p&gt;Providing all the necessary information is supplied with your application, the LIM will be prepared by the Council within 10 working days and forwarded to you as quickly as possible.&lt;/p&gt;

&lt;h2&gt;Cancelling a LIM&lt;/h2&gt;
&lt;p&gt;A LIM application may be cancelled within 48 hours of submission.  This needs to be received in writing clearly identifying applicant details.  In this processing stage any fees will be credited off the application.  No refund of fees will be credited for cancellations received after 48 hours.&lt;/p&gt;

&lt;p&gt;An unformed legal road, or road reserve (commonly called a paper road), is land that is legally held as road but is not currently a formed carriageway.&lt;/p&gt;
&lt;h2&gt;What is a Road Stopping?&lt;a name=&quot;2&quot;&gt; &lt;/a&gt;&lt;/h2&gt;
&lt;p&gt;The sale of unformed legal road for private use is a formal legal process whereby the road is ‘stopped’ taking away its legal status as ‘road’, and then changed into freehold (fee simple) land, enabling the land to be sold.&lt;/p&gt;
&lt;h2&gt;Who can Apply for a Road Stopping?&lt;a name=&quot;3&quot;&gt; &lt;/a&gt;&lt;/h2&gt;
&lt;p&gt;Tasman District Council will consider applications for a road stopping from owners whose land adjoins unformed legal road, or where an encroachment has occurred, provided that suitable alternative land is available for road. (Adjoining owners’ means owners of properties that are immediately next to the land in question.)&lt;/p&gt;
&lt;p&gt;&lt;br/&gt;The Council may sell unformed legal road to an adjoining property owner when it determines the land will not be required for utilities, roads or footpaths in the future. A main requirement will be that the adjoining landowner must amalgamate the portion of stopped road with the landowners existing title. No additional titles will be issued for a portion of stopped road.&lt;/p&gt;
&lt;h2&gt;How to Apply for a Road Stopping&lt;a name=&quot;4&quot;&gt; &lt;/a&gt;&lt;/h2&gt;
&lt;p&gt;As a first step, an initial conversation with a member of the Property Team is welcome as they can advise you of specific requirements for your application and provide any general information you may need. This approach can be an informal meeting at the Council offices, or information sent by email, or a telephone enquiry.&lt;/p&gt;
&lt;p&gt;Formal applications for a Road Stopping should be made to the Manager Property Services, Tasman District Council.&lt;/p&gt;
&lt;p&gt;The application should include sufficient information to enable Council to identify the land in question and ascertain your reasons for the request. Examples of information required:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;A completed Tasman District Council ‘Application for Stopping of Unformed Legal Road’ form (available below);&lt;/li&gt;

			<title>Viewing A Property File </title>

			<description>&lt;h1&gt;&lt;strong&gt;Viewing Property Information&lt;br/&gt;&lt;/strong&gt;&lt;/h1&gt;
&lt;p&gt;Property owners and potential purchasers can view property files by visiting any of the Council's offices in Richmond, Motueka or Takaka.  Council offices hold property files relevant to their location area.&lt;/p&gt;
&lt;p&gt;Most files are available “on demand”, but phoning or emailing &lt;a href=&quot;mailto:info@tasman.govt.nz&quot;&gt;Information at Tasman&lt;/a&gt; the day before you wish to view the property file is recommended.  It will take a full working day to have files transferred between offices. &lt;/p&gt;
&lt;p&gt;Information on the file will include any Council records that we hold at the time of the request relating to completed Building Act and Resource Management Act applications such as:&lt;/p&gt;
&lt;ul&gt;&lt;li&gt;application forms&lt;/li&gt;
&lt;li&gt;drainage plans relating to consented work&lt;/li&gt;
&lt;li&gt;copies of plans and specifications&lt;/li&gt;
&lt;li&gt;Code Compliance Certificates&lt;/li&gt;
&lt;li&gt;Property Information Memorandum (PIMs)&lt;/li&gt;
&lt;li&gt;planning reports&lt;/li&gt;
&lt;li&gt;resource consent decisions&lt;/li&gt;
&lt;li&gt;associated documents.&lt;/li&gt;
&lt;/ul&gt;&lt;p&gt;If you are unable to interpret the information, Council staff will be available to assist.  There is a charge for retrieving files and photocopying information. &lt;/p&gt;
