Background

Resource Consent Applications were lodged by Harakeke 2015 Limited to develop an overall area of 177.8278 hectares to create 130 rural residential-style allotments; 55 apartment allotments; 2 commercial apartments; a reserve and walkway; Open Space allotments; three utility allotments; a separate title for an historic pa site; and associated roads to vest within the Rural 3 Zone in the Aporo Road, Mamaku Road, Marriages Road, Horton Road and Permin Road area, between Tasman Village and Ruby Bay.

The application was amended on 30 March 2016 that increased the size of the productive lot, reduced the number of rural residential allotments from 130 to 116, replaced the proposed reserve area within Permin Road with a walkway and small reserve at its end, and removed one road and its vehicle crossing point onto Horton Road.

Update 8 December 2016 - Close of Hearing

  • The Commissioner panel has today formally closed the hearing for this application.
  • The Commissioners are now completing their deliberations on the revised application and are aiming to release their decision before Christmas if possible.
  • Since our last update on 3 November, the following actions have happened:
    • An opportunity was given for submitters to comment on additional information from the applicant regarding their proposals for management of stormwater in the Horton Road area; and revised draft conditions of consent;
    • Comments were received from eight submitters;
    • The applicant’s written Right of Reply was received on 24 November 2016;
    • The Commissioners requested an updated plan showing the Horton Road stormwater channel for proposed Option 1 in subdivision consent condition 89A. Revised Plan A20 was received on Friday 2 December 2016.
  • All submitters will be notified when the Commissioners’ decision is released.

Update 4 November 2016 - Additional Information and Draft Consent Conditions

  • The additional information asked for by the Commissioners when the second hearing was adjourned has been received, and is now available for submitters to comment on. The information comprises:

    • Additional information from the applicant regarding their proposed management of stormwater in the Horton Road area;
    • Revised draft conditions of consent;
    • A summary page listing key changes to the conditions and those on which Council’s reporting officers have a differing opinion from the applicant;
    • A set of plans to accompany the draft conditions of consent.
  • This is an opportunity for submitters to make further comments, if any, with regard to the revised conditions and the Hortons Road stormwater information only.

  • The Commissioners have emphasised that their request for revised draft conditions from the applicant does not imply that the Harakeke applications will be granted – its purpose is to clarify what is being applied for, given the number of amendments that have been made to the proposals, and the expected conditions if consent is granted.

  • Submitters should send any comments they may have to the Resource Consents Manager by email at phil.doole@tasman.govt.nz, by Noon on Friday 11 November.

  • Comments received will be supplied to the applicant, who will then have five working days to deliver their right of reply – which is usually the last step before the Commissioners will formally close the hearing and make their decision on the application.

Update 4 November 2016 - Commissioners Minute #4

  • The second hearing commenced on Monday 26 September and was adjourned on Wednesday 28 September. The Commissioners requested a revised set of DRAFT conditions of consent, and further information from the applicant regarding the proposed stormwater drainage swale on Horton Road. Please refer to Commissioners Minute #4 below for details.

  • The Commissioners have directed that when it is received, this information is to be made available to submitters who will have five working days to make further comments regarding any changes made to the draft conditions. Any comments received will be supplied to the applicant, who will then have five working days to deliver their right of reply – which is usually the last step before the Commissioners will formally close the hearing and make their decision on the application. Submitters will be advised when the information is available.

Update 12 September 2016

  • The applicant has now provided their briefs of expert evidence. Copies of the evidence are available below.

    • Please note that in the evidence-in-chief of Damian Velluppillai, page 8 refers to annexed documents including Sheets L3 and L4-L7.  These are labelled as Figure B5 and B6 to B9 in the respective Annexes.

    • The graphics bundle for the Masterplan Set has been split into four files, each up to 50MB in size. 

  • Any submitter intending for expert evidence to be presented in support of their futher comments must provide it to Council by 3.00pm Monday 19 September 2016

Update 2 September 2016

  • The Council’s second report on the Harakeke applications for resource consent has now been finalised. A copy of the report is available below. The report comprises 82 pages of appraisal of the various aspects of the proposed development, followed by 47 pages of Draft Conditions for the suite of consents applied for. The attachments are in a separate 10 MB size document, also available below.

  • The next step is that the applicant must provide any briefs of expert evidence for the hearing to Council by 3.00pm on Monday 12 September 2016, as agreed by the Commissioners on 19 August (amending their directions as set out in Minute #3).

  • Council received further comments on the amended applications from 20 submitters. Any submitter intending for expert evidence to be presented in support of their submission must provide it to Council by 3.00pm Monday 19 September 2016

Update 31 May 2016

  • On Monday 23 May 2016 the applicant confirmed their request to suspend processing of this application while they work on amendments to the proposed development. The Commissioners have now issued Minute #2 which expects that an amended application will be provided by Friday 8 July 2016, to be followed by an opportunity for submitters to comment.

Update 23 May 2016:

  • The hearing of the Harakeke subdivision proposal and associated resource consent application commenced on Monday 16 May 2016 as scheduled.  The hearing was adjourned at the close of the day on Thursday 19th May, after 4 days of presentations from the applicant, 20 submitters, and Council’s experts (those who provided technical reviews in support of the Council officers’ report).

  • The adjournment was requested by the applicant, with an indication that they are considering further changes to reduce the extent of the proposed developments.  An amended master plan was presented which gives an indication of the changes, a copy of which is available for download below.  At this point Council is waiting for a summary of the intended changes, which will be added to this page when received.

  • The Resource Management Act 1991 allows for the applicant to suspend the process at any stage before completion of the hearing.  The Commissioners also indicated that they would be requesting more information on some aspects of the proposed developments, particularly with regard to stormwater management. 

  • The Commissioners have asked the applicant for a proposed timeframe for when information explaining the amended proposal will be suppled. They also indicated that all existing submitters will be given 20 working days to make comment on the new information, if they wish to do so.  What the process will be from that point is yet to be determined.  Further updates will be posted when possible.

Update 31 March 2016: Revised Resource Consent Documents

The applicant has now submitted amendments to their application and a copy of the revised documents can be downloaded from the link provided below. Summary of key changes are:

Update 8 March 2016: Rescheduled Hearing

This deferral of the hearing results from the applicant advising that they are amending their application within the scope of the original proposal. Council expects to receive the full amendments by Wednesday 30 March 2016. They will be linked to Council’s web page and submitters will be advised accordingly.

When the staff reports are circulated, submitters who advised their wish to be heard will be asked to indicate a day and time so that an order of proceedings can be arranged for the week.
Submitters who are calling expert evidence should note that the Commissioners may want to hear evidence by topic, which will influence the order of proceedings.
