Talley’s Group Limited have lodged an appeal against the Hearing Commissioner’s decision with the Environment Court on 18 January 2018. The Court has directed all the parties to attend a mediation on 7 August 2018.

  • All submitters should have received a copy of the notice of appeal direct from the appellant’s agent.
  • The appeal process is managed by the Environment Court. The Court has directed that the matter goes to mediation first.

Update 7 December 2017 - Decision Released

Further to the update on 20 November:

  • The Hearing Commissioner's decision on the Talley's Group Ltd application for water and air discharge permits associated with industrial activities at Port Motueka has been notified to the applicant and submitters today.
  • The consents have been granted, subject to conditions.
  • Permit RM140157 authorising discharge of wastewater containing contaminants to coastal waters has been granted for a term of 3 years only.
  • Permit RM140158 authorising discharges to air has also been granted for a term of 3 years only.

Update 20 November 2017 - Close of Hearing

Further to the update on 24 October:

  • The applicant asked for an extension of time for submitting their written right of reply.
  • The applicant's written right of reply was received on Friday 3 November.
  • The Hearing Commissioners' issued Minute No 2 dated Wednesday 8 November seeking clarification from the applicant regarding discharges from the seawater scrubber, and comment from the Council's reporting officers on that matter.
  • The applicant's response was received Friday 10 November, followed by the reporting officers' comments on 14 November, and both were forwarded to the Commissioners.
  • The Commissioners have closed the hearing today 20 November 2017.
  • The Commissioners' decision on the application is expected to be issued within 15 working days.

  • Further to the Hearing Commissioners’ Minute dated 25 August 2017, Council’s reporting officers have now provided comments on the further information that was received from the applicant on 22 September 2017.

  • In accordance with the Commissioners’ directions, those submitters who are being heard now have 10 working days to provide any comments they wish to make on this further information.  Written comments must be received by Council by Friday 20 October 2017.

  • The Hearing Commissioners issued a Minute dated 25 August 2017 confirming their request for further information and subsequent circulation of that material, including revised draft conditions of consent provided by Council’s reporting officers.
  • The applicant requested an extension of time, out to Friday 22 September 2017, and that was agreed to by the Commissioners.
  • A response from the applicant has now been received (refer to the 2 documents linked below).
  • Now the Council’s reporting officers have up to 10 working days to make comment (up to Friday 6 October), and after that the submitters being heard will have10 working days to make any comments.

Background

Resource Consent Applications were lodged by Talley's Group Limited on 31 March 2014 for the continued operation of a fish processing and food manufacturing plant at the existing Motueka Wharf facility.  The operation of the facility comprises three distinct processes:

  • wet fish and shellfish processing and value added product preparation;
  • manufacture of ice cream;
  • processing of fish offal to produce fishmeal.

The application was publicly notified on 16 April 2016 and 36 submissions were received.

A hearing has been set down to commence on Monday, 29 May 2017 at 9.30 am and will continue each day until Friday, 2 June 2017, and will be heard by commissioners in the Elm Room, Headingly Centre, 452 Lower Queen Street, Richmond.

All parties wishing to be heard are expected to attend at the commencement time so that an order of proceedings can be established, unless you make prior arrangements. At the hearing, the Chairperson may ask you to indicate how much time you will need to speak to your submission.

The Consent Authority has directed that the staff reports and expert evidence be provided before the hearing pursuant to Section 103B of the Act. Therefore, the following timeframes apply:

  • The Staff report(s) must be received by the applicant, and to every person who made a submission and stated a wish to be heard at the hearing, by 4.00pm on Friday, 5 May 2017.
  • The applicant must provide their briefs of evidence electronically to Council by 4.00pm on Friday, 12 May 2017.
